In a landmark decision poised to reshape digital privacy and law enforcement practices across the United States, the U.S. Supreme Court ruled on Monday to significantly limit the use of "geofence" search warrants. The 6-3 ruling declared that individuals possess a "reasonable expectation of privacy in his cell-phone location information," asserting that privacy rights extend to location history collected by mobile devices and the applications running on them. This judgment marks a significant victory for privacy advocates and sets a new precedent for how authorities can access sensitive user data.
The court's decision mandates that law enforcement agencies must now obtain a search warrant, backed by probable cause, when requesting historical geofence location data from tech giants like Google. Crucially, the Supreme Court argued that the "third-party doctrine" – which typically suggests individuals have no privacy expectation for data willingly shared with others – does not apply in this context. This is because users are not willingly sharing their detailed location data with companies simply by using their services, differentiating it from data shared with, for example, telecom providers. Geofence warrants enable police to define a geographical area and a time frame, then compel tech companies to identify all users whose devices were present within that zone.
Critics have long assailed these "reverse" search warrants as unconstitutional and overly broad, arguing they indiscriminately sweep up data from innocent individuals. The Supreme Court appeared to concur with these concerns, though it refrained from an outright ban on geofence warrants. Instead, the ruling allows for their continued use, provided police narrow their data requests when seeking a search warrant. Essentially, the court affirmed that the Fourth Amendment, which safeguards against unreasonable searches and seizures, fully applies to location data collected by companies from users' cellphones.
The ruling stems from the pivotal case of Chatrie v. United States, where Okello Chatrie challenged the government's use of evidence gathered via an allegedly unconstitutional geofence warrant during his bank robbery trial. Chatrie's legal team contended that such warrants permit investigators to "search first and develop suspicions later," thereby subverting established norms requiring authorities to establish probable cause linking an individual to a crime before demanding data. This case highlighted a nationwide split in lower courts regarding the legality of geofence warrants, necessitating the Supreme Court's intervention.
While the decision does not halt law enforcement's ability to obtain historical cellphone location data, it firmly establishes the requirement for a valid search warrant demonstrating probable cause. The immediate impact on Chatrie's specific sentence remains uncertain, as previous courts had deemed the evidence collected in "good faith." The Supreme Court has now remitted the case to the Appeals Court to determine whether the original search warrant indeed met the probable cause standard. In anticipation of such rulings, some tech companies, notably Google, have already begun storing users' location data directly on their devices rather than on central servers, compelling investigators to approach users directly. Other major platforms like Microsoft, Uber, and Yahoo continue to receive regular geofence warrant requests.
