The global supply chain for critical minerals has once again faced significant disruption, highlighting persistent vulnerabilities. In April 2025, China's decision to tighten export licenses on seven rare-earth elements triggered a familiar wave of concern and reactive measures from Western governments. The European Union swiftly responded by accelerating the issuance of extraction permits under its Critical Raw Materials Act. Simultaneously, the United States expanded subsidies aimed at bolstering domestic refining capabilities for these vital minerals through the Inflation Reduction Act. Furthermore, the Minerals Security Partnership, a collaborative initiative launched in 2022 by fourteen economies, moved to incorporate more producing partner countries into its framework, aiming to diversify sourcing.
These responses, while seemingly proactive, are rooted in a common, yet partially flawed, understanding of the problem. The prevailing diagnosis posits that the challenges in critical mineral supply are primarily geological and geographical. According to this view, the solution lies in a straightforward approach: extract more raw materials, enhance refining capacities, and broaden the geographical base of suppliers. This perspective has guided policy decisions for the past five years, following a series of similar shocks to the mineral supply chain.
However, this diagnosis, while containing an element of truth, is critically incomplete. It overlooks what has now emerged as the most significant and binding constraint on widening access to these essential materials: intellectual property. The focus on simply finding more deposits or building more refineries misses the deeper structural issues related to the proprietary technologies and knowledge required for efficient and environmentally sound extraction, processing, and refining.
Intellectual property, encompassing patents, trade secrets, and specialized know-how, often dictates who can effectively process and utilize these minerals. Even if new sources are discovered or new refining facilities are constructed, the underlying technologies and expertise might remain concentrated in the hands of a few entities or nations. This concentration of intellectual property can effectively create bottlenecks, limiting the ability of new players to enter the market or existing players to scale up operations without licensing agreements or significant investment in R&D to develop alternative methods.
Therefore, while efforts to diversify geographical sourcing and increase extraction are necessary, they alone are insufficient to address the full scope of the critical minerals challenge. A comprehensive strategy must also confront the intellectual property barrier. This necessitates exploring mechanisms for technology transfer, fostering open innovation, or developing new international frameworks that facilitate broader access to the advanced processing techniques crucial for these materials. Without addressing the IP constraint, the world will continue to grapple with supply vulnerabilities, despite abundant geological resources.
